Sri Kamal Krishna Roy, learned counsel for the petitioners, learned Standing Counsel for State-respondents and Sri Satish Kumar Rai, learned counsel for the respondent no. 2 and Sri Ashish Mohan Srivastava, learned counsel for respondent no. 3.
It is the case of the petitioners that they were allotted certain lands by the Cantonment Board, Meerut for carrying tehbazari business. It is submitted that the petitioners are carrying on their tehbazari business for the last more than 30 years and are paying tehbazari charges/rent to the Cantonment Board under the law Petitioners are aggrieved by a notice issued by the CEO, Meerut Cantt. whereby they have been asked to vacate the land in question for a project of Rapid Rail to be done by the National Capital Region Transport Corporation.
Sri S.K. Rai appearing for the Cantonment Board, on instructions, submits that on the basis of resolution dated 21.01.2021, the petitioners have now been rehabilitated to Mangal Pandey Bazar for carrying on their tehbazari business. He submits that the petitioners may proceed for carrying on their tehbazari business on the re-located place as per the terms and conditions already prepared by the Cantonment Board.
Learned counsel for respondent no. 3 submits that his client would be setting up the shops to be allotted to the petitioners and they would construct their shops as expeditiously as possible.
Learned counsel for the petitioner submits if any such alternative land is available, they would be willing to shift their business to such land as per the offer made by the Cantonment Board.
In view of above, no orders are required to be passed in the writ petition.
The writ petition is consigned to record.
