Heard learned counsel for the applicant and learned counsel appearing for the complainant and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant submits that the there is no legal evidence against the applicant; the cremation of the deceased was done in the presence of all the villagers; the only evidence against the applicant is of last seen, applicant is languishing in jail since 2.5.2017, hence the applicant may be released on bail.
Learned A.G.A. and learned counsel for the informant has vehemently opposed the prayer for bail contending that the motive behind the murder is property, the deceased was having two daughters; applicant is not legal heir of the deceased; the deceased went along with the applicant to execute the sale-deed to settle her debts incurred for the marriage of one of her daughter; fraudulently along with sale-deed, will-deed of the entire property was also got executed by the applicant; name of the legal heirs was mutated; thereafter, the will surfaced; it is urged that at this stage it would not be in the public interest to enlarge the applicant on bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Pankaj Singh involved in Case Crime No. 111 of 2016, under Sections 302, 201, 364, 420 IPC, P.S. Madnapur, District Shahjananpur.
Accordingly, the bail application is rejected.
However, the trial court is further directed to expedite the trial of the aforesaid case and conclude the same expeditiously from the date of production of a certified copy of this order.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
