Heard Sri A.K. Mishra, learned counsel for the petitioner and Sri N.K. Verma, learned AGA for the State.
Learned counsel for the petitioner states that he has received instructions that the offence u/s 395 and 397 IPC has been dropped and the case has been converted u/s 394 IPC but there is no averment made in the petition for the same nor any document has been annexed regarding the same. He states that the present petition be dismissed as not pressed with liberty to file fresh petition.
The present writ petition is, accordingly, dismissed as not pressed with liberty to file fresh petition.
Office is directed to return the certified copy of the FIR to the learned counsel for the petitioner after retaining a photocopy of the same.
