This writ petition has been filed, inter alia, for the following relief:
" (i) Issue a writ, order or direction in the nature of mandamus directing the respondent authorities to provide protection to the petitioner and his family members who are taking care of him and further to prevent encroachment upon personal life and liberty of the petitioner as provided under Article 2 of the Constitution of India in accordance with law."
A perusal of record shows that the petitioner is seeking a direction against a private party i.e. respondent no. 6, who happened to be the wife of the petitioner, is allegedly trying to grab the property of the petitioner in dispute in collusion with the respondents no. 7 and 8 and they are continuously threatening the petitioner and unnecessarily harassing him each and every day with an evil design to usurp his property and an F.I.R. to that effect has been lodged by the petitioner in case crime no. 305/19 under sections 504 and 506 I.P.C. at Police Station Badagaon District Varanasi but till date the Inspector of the concerned police station has not taken any action against them and is watching the matter as a silent spectator and as such the danger to his life and property is still subsisting.
Heard learned counsel for the petitioner and perused the record.
Considering the facts and circumstance of the case, it is provided that in case the petitioner is aggrieved with any illegal act of the respondents, the petitioner, if so advised, may take proceedings before the common law court in accordance with law for redressal of his grievances. However, it is made clear that if the danger to the life and property of the petitioner is still persisting, he may approach the Senior Superintendent of Police concerned ventilating his grievances, who shall look into the matter personally and do the needful in accordance with law.
With the aforesaid observation, this writ petition stands disposed of.
