The petitioner has challenged the allotment of Rural Retail Outlet Dealership in favour of respondent no. 4, inter alia, on the ground that he has secured the allotment on the basis of the fabricated and forged documents. It was alleged by the petitioner that the caste certificate procured by the respondent no. 4 was on the basis of the incorrect facts.
On 3rd January, 2019, we have asked the learned counsel for the respondents to seek the instructions in the matter. Sri Pramod Kumar Rai, learned counsel for the respondents has received the instructions. On the strength of the instructions, he submits that the complaint made by the petitioner has been found to be correct. Accordingly, the allotment made in favour of respondent no. 4 has been cancelled and a decision has been taken to invite a fresh application, in which the petitioner may also participate.
In view of the said facts, we are of the view that no cause of action survives. In regard to the prayer of the petitioner that the contract be allotted to him, we observe that if the petitioner is entitled, in pursuance of the fresh advertisement, it is open to him to make an application for the same.
With the aforesaid observation, the writ petition stands disposed of.
