Learned Standing Counsel has obtained instructions according to which petitioner has been declared medically unfit by the Board constituted for the purpose on the ground of B/L Varicocele.
Although it is urged that the petitioner does not suffer from any such defect/ deformity yet the documents annexed at pages 68 and 69 of the writ petition would go to show that the petitioner has been given medical treatment for the decease. The determination by the medical board of petitioner's status as medically unfit, therefore, cannot be said to be perverse or erroneous so as to require any further scrutiny. The opinion of the medical board is otherwise liable to due weight.
Dismissed, accordingly.
