Sri J.B. Singh, Advocate has filed his power on behalf of the aggrieved person which is taken on record.
Heard Sri V.P. Mishra, learned counsel for the applicant, Sri J.B. Singh, learned counsel for the aggrieved person, Sri G.P. Singh, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant was allotted a plot but there appears to be some dispute between the parties. He had not taken any amount from the aggrieved person Kuldeep Sharma. The recovery which has been issued by the Departmental Authorities to the tune of Rs.3,73,00,000/-, the applicant is ready to refund the same.
Learned counsel for the aggrieved person as well as learned A.G.A. have vehemently opposed the prayer for bail to which learned counsel for the applicant has raised a preliminary objection regarding objection raised by the aggrieved person.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant Pankaj Kumar, involved in Case Crime No.489 of 2019, u/s 420, 467, 468, 471 IPC, P.S. Nauchandi, district Meerut.
Accordingly, the anticipatory bail application is rejected.
However, the applicant is at liberty to move bail application u/s 439 Cr.P.C., if so advised.
