Heard Sri S.K. Pandey, learned counsel for the petitioner- appellant and learned Standing Counsel.
The claim of the petitioner-appellant for grant of compassionate appointment had been turned down and the writ petition against that order had been dismissed. The facts of the case reveal that the father of the petitioner- appellant died on 8.12.1995 while in service. The petitioner-appellant moved an application for grant of compassionate appointment on attaining majority after 8 years of the death of his father. Ordinarily, such applications are expected to be moved within 5 years of the death and it is only in exceptional circumstances, the period can be relaxed. The petitioner-appellant failed to make out any exceptional circumstances for grant of any such relaxation, and none has been pleaded before the Court.
In view of the above, we find no illegality in the order of learned Single Judge in dismissing the writ petition. The appeal lacks merit and is accordingly dismissed.
