Petitioner applied for appointment to the post of Constable against advertisement dated 16.11.2018. Having cleared different stages of recruitment he was examined medically on 09.03.2021 and declared unfit. In terms of the applicable provisions an appeal was preferred and the petitioner was to appear before the Divisional Medical Board on 12.03.2021, accordingly. Petitioner's mother is stated to be suffering from Cancer and since she required immediate attention on 12.03.2021, the petitioner could not appear before the Divisional Medical Board. A representation appears to have been sent on 20.03.2020 explaining such facts for holding a fresh medical by the Divisional Medical Board. Since no decision has been taken upon his representation the petitioner is before this Court.
Learned Standing Counsel states that grievance of the petitioner, is raised in his representation shall be duly addressed, in accordance with law.
In that view of the matter this petition stands disposed of permitting the petitioner to raise his grievance before respondent no.3 along with a copy of this order. The claim of the petitioner shall be duly examined in terms of the applicable scheme and in accordance with law, and an appropriate order would be passed in that regard within a further period of two months thereafter. In the event respondent no.3 is not the competent authority to take a decision he shall forward the claim to the competent authority who shall take necessary decision in terms of the above direction.
