Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri Yatindra, learned counsel, appearing on behalf of respondent no. 4.
The present writ petition has been filed stating that in terms of the vacancy approved, the petitioner was given the additional charge of District Physical Teaching Instructor.
It was alleged that certain complaints were made against the petitioner and the petitioner was placed under suspension on 07.08.2020 and enquiry was directed to be conducted.
The counsel for the petitioner argues that the enquiry has been concluded and an enquiry report dated 07.06.2021 has been forwarded to the respondent no. 3, however, the said report is pending with the respondent no. 3 and no further actions, as requested by the petitioner, are being taken in respect of the claims made by the petitioner, more so, with regard to his continuity as a Physical Training Instructor.
Considering the fact that the report dated 07.06.2021 has already been forwarded with the respondent no. 3, it is thus directed that the respondent no. 3 shall take a decision with regard to report forwarded before him through letter dated 14.6.2021 as contained in Annexure No. 9 to the writ petition, as expeditiously as possible, preferably within a period of two months, from the date of filing a copy of this order before the respondent no. 3 The writ petition stands disposed off in terms of the said direction.
