Petitioner claims to be the senior most L.T. Grade Teacher and is seeking consideration for his claim for promotion to the post of Lecturer in Economics. It is stated that the petitioner possess requisite qualification for appointment. Attention of the Court has been invited to a communication of District Inspector of Schools addressed to the Management/ Principal dated 13.3.2018, whereby, a direction has been issued for forwarding petitioner's claim to the Inspector concerned for its due consideration by the competent authority in terms of Rule-14 of the 'U.P. Secondary Education Services Selection Board Rules, 1998'. Submission is that although a period of more than 6 months have lapsed since then but no action has been taken.
Learned Standing Counsel states that an appropriate decision would be taken by the competent authority, in accordance with law.
This court finds that once the District Inspector of Schools has already taken cognizance in the matter and a direction has been issued to the institution concerned to forward petitioner's claim alongwith the claim of other eligible persons, the authorities are expected to act, accordingly. The District Inspector of Schools shall ensure that the claim of the petitioner alongwith claim of other eligible persons, in terms of Rule-14 of Rules of 1998, is transmitted to the Regional Level Committee for its due consideration within a period of two months from the date of presentation of certified copy of this order. The Regional Level Committee shall thereafter pass an appropriate order upon the claim of petitioner, while considering the claim of other eligible persons, within a further period of two months thereafter.
With the aforesaid observations, writ petition stands disposed of.
