JUDGMENT / ORDER

The writ petition has been filed seeking direction to opposite party no.3 to provide the scanned copy of answer book of the petitioner bearing Roll No. 63650502562 relating to Assistant Teacher Recruitment Examination-2018 and also to re-evaluate his answer book.
Learned counsel for the petitioner submitted that the assistant teacher Recruitment Examination-2018 was conducted by the opposite party no.3 on 27.5.2018 for selection on the posts of 68500 assistant Teachers in pursuance to the advertisement dated 23.1.2018. the petitioner has appeared in he said selection and attempted most of the questions but when the result was declared on 13.08.2018 he was secured only 26 marks. Learned counsel further submitted that pursuant to G.O. dated 5.10.2018 opposite party no.3 issued notice dated 10.10.2018 inviting online applications for re-evaluation of answer sheets from the candidates,who appeared in the said selection. He further submitted that the online application submitted within the stipulated period provided in the notice dated 10.10.2018 has been duly received by the respondents. The result of the re-evaluation has been declared and the petitioner again declared unsuccessful. On 17.9.2019 the petitioner has deposited Rs.2000/- through demand draft for scanned copy of the answer sheets. The argument is that the other candidates who has applied for scanned copy on payment of Rs.2000/- has been made available to them but in the case of petitioner, he has not been made available the scanned copy of the answer sheets after a lapse of 10 months.
Per contra learned Standing Counsel pointed out that as per Annexure-6 of the paper book petitioner was found unsuccessful in the re-evaluation of the answer sheets. He submitted that in case of other candidates the scanned copy was made available before the result of the re-evaluation and since the result of re-evaluation has already been declared, the petitioner is not entitled for scanned copy of the answer sheets.
I have heard the leaned counsel for the parties and perused the record.
Since it is admitted tact that the scanned copy has already been made available to other candidates before the pronouncement of the result of re-evaluation and the only dispute is that the said scanned copy relating to the petitioner has not been made available to him as result of re-evaluation has already been declared. It is admitted fact that the petitioner has applied online application for scanned copy of the answer sheets well before the result of the re-evaluation and he has also deposited the required fee for the said purpose.
In view of the facts and circumstances, if there is no legal impediment to make available the answer sheet to the petitioner, the opposite party no.3 is directed to make available the answer sheet as prayed in prayer clause 1 of the writ petition within three weeks from the date of production of a certified copy of this order.
With the above directions the writ petition is disposed of.
