This writ petition has been filed with a prayer to issue a writ, order or direction in the nature of mandamus commanding the respondent authority to conduct fair and impartial investigation in Case Crime No. 598 of 2018, under Sections 420, 406, 506 IPC, Police Station- Noida Sector-20, District- Gautam Budh Nagar.
Sri Pankaj Kumar Shukla, learned counsel for the petitioners submitted that in spite of order passed in favour of the petitioners by co-ordinate Bench of this Court in Criminal Misc. Writ Petition No. 12927 of 2018 (Pankaj Kumar Arya and 2 Others Vs. State of U.P. and 3 Others) dated 22.05.2018, the investigation has not been concluded till date by the investigating officer as the informant of the present case disclosed the respondent No.2 but the informant has not been made party in the present petition, hence petition is dismissed as withdrawn with liberty to file fresh. Learned A.G.A. for the State is present.
Accordingly, the present petition is dismissed as withdrawn with liberty to file fresh.
Office is directed to return the certified copy of the F.I.R. to learned counsel for the petitioners after retaining a copy of the same.
