It is submitted by learned counsel for the petitioner that by the impugned order, respondent no.2 has illegally directed for keeping in abeyance the final order passed by him on 03.02.2016 on the application moved before him by the petitioner under Section 14 of the SARFAESI Act. He has further submitted that the impugned order being without any sanction of law and without jurisdiction is liable to be set aside.
The submission prima facie appears to be correct.
Matter requires consideration after receiving response from opposite parties.
Notice on behalf of respondent nos. 1 and 2 has been accepted by learned Standing Counsel who prays for and is allowed four weeks time to file counter affidavit.
Issue notice to respondent nos. 3 to 8 who may also file their counter affidavits within the same period.
Rejoinder affidavit, it any, may be filed within two weeks thereafter.
List on 14.05.2018.
In view of the submissions made by learned counsel for the petitioner, it is directed that until ordered otherwise, the effect and operation of the impugned order dated 03.02.2016 shall remain stayed.
