FOR R-3) THIS WRIT PETITION IS FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE R-2 TO CONSIDER THE APPLICATION DTD:22.09.2012 (ANNEXURE-C) OF THE PETITIONER AND GRANT SUBSIDY OF RS.15 LAKH TO THE PETITIONER IN TERMS OF THE CREDIT LINKED CAPITAL SCHEME WITHOUT RAISING THE ISSUE OF THE OUT OFF DATE .
THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Sri.A.S.Mahesh, learned counsel for the petitioner.
Sri.Prashant N. Hegde, learned counsel for respondent No.1.
Sri.M.Mohan Rao, learned counsel for respondent No.2.
Sri.Rohith B.J, learned counsel for respondent No.3.
In this petition, the petitioner seeks for a direction to respondent No.2 to consider the application dated 22.09.2012 (Annexure-C) of the petitioner and grant subsidy of Rs.15 lakhs to the petitioner in terms of the Credit Linked Capital Subsidy Scheme without raising the issue of the cut off date.
2. When the matter was taken up today, learned counsel for the petitioner submitted that the writ petition may be disposed of with a direction to the competent authority to decide the representation submitted by the petitioner in accordance with law.
3. In view of the aforesaid submission, the writ petition is disposed of with a direction to the competent authority to consider and decide the representation submitted by the petitioner, if not already decided, in accordance with law by a speaking order within a period of four months from the date of receipt of the certified copy of the order passed today.
4. It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the petition is disposed of.
