Heard learned counsel for the revisionist.
Submission is that the proceedings in case No. 3737/9 of 2009, State Vs. Ayodhya Prasad, under Sections 427, 435, 506 I.P.C. and 3 (1) (10) SC/ST Act, Police Station Bhopa, District Muzaffarnagar, as counter blast initiated by opposite party no.2 has been challenged in the instant revision.
Issue notice to opposite party no.2 returnable at an early date. Counter affidavit may be filed within three weeks from the date of receipt of the notice. Rejoinder affidavit may be filed within three weeks thereafter.
List after expiry of the aforesaid period.
Operation of the summoning order dated 05-10-2009 passed by Judicial Magistrate-Ist, Muzaffarnagar in Case No. 3737/9 of 2009, State Vs. Ayodhya Prasad, under Sections 427, 435, 352, 506 I.P.C. and 3 (1) (10) SC/ST Act, Police Station Bhopa, District Muzaffarnagar shall remain stayed, till the next date of listing.
