Heard learned counsel for the applicant and the learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the impugned charge-sheet no. 129-A of 2019 dated 25.5.2019 and cognizance order dated 26.7.2019 as well as entire proceedings of criminal case no. 2118 of 2019 (State Vs. Navneet Gupta @ Sanu Gupta and Another) pending in the court of learned Chief Judicial Magistrate, Pilibhit arising out of Case Crime No. 0103 of 2019, under sections 363, 102-B and 506 I.P.C., Police Station-Pooranpur, District-Pilibhit.
Learned counsel for the applicant submits that applicant has been falsely implicated in this case. He further submits that applicant is a private tutor and victim was her student. He further submits that on the perusal of the F.I.R. no offence against the applicant is made out.
Matter requires consideration.
Notice on behalf of opposite party no. 1 has been accepted by learned A.G.A.
Issue notice to opposite party no. 2 returnable at an early date.
Opposite parties may file their counter affidavits within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, no coercive measure shall be taken against the applicant in the aforesaid case.
