The petitioner Institution has filed the instant petition seeking a mandamus commanding the respondents to sanction and release fee reimbursement and scholarship of SC/ST students of the Institution, who were admitted on zero fee basis and whose scholarship amount has not been reimbursed so far. The case of the petitioner is that for Academic Session 2014-15, the amount has not been reimbursed in respect of 190 students and for the year 2015-16 in respect of 1 student. It is pointed out that the Deputy Director, Social Welfare Department by communication dated 07.03.2017 called for a report from the District Social Welfare Officer, Meerut in respect of the claim of the petitioner Institution for the Academic Years 2014-15 & 2015-16, but since no report has been submitted, therefore, no decision has been taken.
Sri Rohit Pandey, learned counsel for the petitioner has also relied on judgments passed by this Court in similar facts in Writ-C No. 13749 of 2018 and Writ-C No. 44680 of 2017.
Learned Standing Counsel submitted that respondent No. 2 is competent to examine the grievance of the petitioner.
Accordingly, the instant petition is disposed of with liberty to the petitioner to make a fresh representation before respondent No. 2 along with certified copy of this order, and in which event, the same shall be decided by respondent No. 2, by means of a speaking order within next three months.
The Court has not gone into the veracity of the assertions in the writ petition nor has the claim of the petitioner been judged on merits. It is onerous responsibility of the State authorities to diligently enquire into the matter and verify the claims of the petitioner after independent application of mind.
