Heard learned counsel for the petitioner and learned Standing Counsel.
Learned counsel for the petitioner submitted that, in fact, the petitioner has deposited only 1/3rd amount of deficient stamp duty along with interest which comes to Rs.3,19,029/- of the entire deficient amount. The petitioner has also not deposited the penalty of Rs.10,900/- and, therefore, prayed that the order dated 9.2.2011 be modified staying the balance amount towards deficient stamp duty and the penalty amount. On 9.2.2011, on the statement of learned counsel for the petitioner that the entire amount has been deposited, the Court has passed the order that no interim order is required. However, having regards to the facts and circumstances, the Court modifies its order dated 9.2.2011 to the extent only that the petitioner may deposit the entire amount towards deficient stamp duty and the penalty and interest shall remain stayed.
The application is accordingly disposed of.
