Learned counsel for the petitioner may implead the Gaon Sabha as a respondent in the case and also serve a copy of the petition upon the learned counsel for the Gaon Sabha Sri Pradeep Singh.
Heard learned counsel for the petitioner, Sri Jay Prakash Singh learned counsel for the respondents, learned counsel for the Gaon Sabha and the learned Standing Counsel.
This writ petition was filed with a prayer that the notice dated 11.11.2021 be quashed and also the order dated 28.12.2018 by which the restoration application had been rejected be quashed. Still further it has been prayed that the order dated 28.8.2017 passed under Section 122B of the U.P.Z.A. & L.R. Act be also set aside.
By means of supplementary affidavit, learned counsel for the petitioner has informed that a Revision has been filed against the order dated 28.12.2018.
Under such circumstances, without going into the merits of the case, it is being directed that the Revision being Revision No. 2675 of 2021 be decided within a period of one month from the date of presentation of a certified copy of this order, unless there is any legal impediment.
It may be stated that the Court has not decided the case on merits.
For a period of one month or till the Revision is decided whichever is earlier, the effect and operation of the notice dated 11.11.2021 shall remain stayed.
With these observations, the writ petition is disposed of.
