Mr.Pandya, learned APP waives service of notice of Rule.
The present application has been preferred by the applicant - convict for temporary bail on the ground that he wants to attend marriage ceremony of his niece and nephew.
It appears from the jail report that the convict was recently released on temporary bail from 17.5.2011 to 31.5.2011 and the ground is not such where his presence cannot be said to be indispensable.
Hence, the discretion does not deserve to be exercised. Therefore, the application is rejected. Rule discharged.
