Heard learned counsel for the applicant, Sri Babu Lal Ram, learned counsel for the informant and learned A.G.A. for the State.
The instant anticipatory bail application has been filed on behalf of the applicant, Pancham Yadav, with a prayer to release him on bail in Case Crime No. 144 of 2020, under Section- 419, 420, 504, 506, 467, 468, 471 I.P.C., Police Station- Kotwali, District- Ghazipur, during pendency of trial.
Despite time granted, no counter affidavit has been filed by learned A.G.A.
There is allegation against the applicant that he has sold the government land to the informant.
Learned counsel for the applicant submits that the allegation is incorrect. Charge-sheet has been submitted against the co-accused persons. Investigation is pending against the applicant.
The applicant has already been enlarged on interim anticipatory bail by this Court by order dated 01.02.2021.
Applicant will remain on anticipatory bail till cognizance is taken by the court on the police report u/s 173 (2) Cr.P.C. on same terms and conditions as mentioned in the order dated 01.02.2021.
The anticipatory bail application is allowed to the aforementioned extent.
