Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents no. 1 to 5 and Sri Manoj Kumar Yadav, learned counsel for the respondent no. 6-Gaon Sabha and perused the record.
Present petition has been filed with a prayer to direct the respondent authorities to remove illegal encroachment of khadanja done by the respondents from the land i.e. house no. 65 ka situated at Village Ukani Pargana Mugra, Block Mugra Badshahpur, Tehsil Machhali Shahar, District Jaunpur in accordance with law.
Petitioner has filed present petition as Public Interest Litigation, however, perusal of record indicates that interest of the petitioner is involved in the present case. As such, it cannot be said to be a public interest litigation.
Present petition is accordingly dismissed.
However, the petitioner is at liberty to avail the remedy as may be available to him in law.
