1. Heard Sri A.L. Jaiswal, learned counsel for appellant and Sri Mukesh Kumar Singh, learned counsel for respondents and perused the record.
2. This petition has been preferred against the judgment and award dated 9.05.2005 passed by Motor Accident Claims Tribunal/Additional District Judge, Court No. 17, Allahabad, whereby awarding a sum of Rs.7000/- as compensation to the claimant.
3. The matter requires consideration.
4. Going through the record, this Court has suggested to the counsel for appellant as the only question is regarding the quantum enhancement of Rs.20,000/- would be just and proper, looking to the injuries of the appellant.
5. However, it is vehementally objected by Sri Mukesh Kumar Singh, learned counsel for respondent that this Court feels that Rs.20,000/- is just and proper with 9% interest from the date of filing of claim petition till judgment and award, 6% thereafter till the amount is deposited.
6. The award stands modified to the aforesaid extent. The amount be deposited by U.P.S.R.T.C. within 12 weeks from today, if the said amount is not deposited within 12 weeks, 6% be read as 9% interest.
7. The appeal is partly allowed.
