JUDGMENT / ORDER

The petitioner in these review petitions is the Welfare Committee of Sree Mookambika Temple at Pallikkunnu. The petitioner Committee was the 4th respondent in W.P.(C) No.23676/2014 as also in W.P.(C) No.23825/2014. The petitioner in W.P.(C) No.23676/2014 is a devotee of the said temple and the petitioner in W.P.(C) No.23825/2014 is a member of the said Welfare Committee.

The case of the petitioners in the Writ Petitions was that the Committee referred to above was constituted as directed by this Court as per judgment in W.P.(C) No.5124/2012 on 25.08.2013, for a period of one year and that the said Committee was continuing even after the expiry of the term for which it was constituted. As the term of the Committee was one year, this Court on 26.09.2014 directed the 3rd respondent in the R.P. Nos. 829 & 892 of 2014 in W.P.(C) Nos. 23676 & 23825 of 2014 -2-
Writ Petition to constitute a fresh Committee.

The review petitioner seeks review of the judgment on the ground that Annexure A1 order issued by the Malabar Devaswom Board provides that even though the term of the Committee is only one year, if required, the term can be extended for a total period of three years. According to the review petitioner, this aspect of the matter has not been adverted to or considered by this Court while rendering the judgment sought to be reviewed.
4. Annexure A1 is the order by which the Executive Officer of the temple was authorised to constitute the Committee. After the constitution of the Committee, the Assistant Commissioner of the Board, as per Ext.P4, approved the constitution of the Committee subject to conditions. Condition No.2 in Ext.P4 is categoric that the term of the Committee shall only be one year. As such, the review petitioner cannot seek extension of the term of office on the strength of Annexure A1 order. That apart, Annexure A1 does not confer any right on the R.P. Nos. 829 & 892 of 2014 in W.P.(C) Nos. 23676 & 23825 of 2014 -3-
members of the Committee to seek extension of the term of office of the Committee. The said clause in Annexure A1 order is only a provision conferring authority on the Malabar Devaswom Board to extend the term of office of the Committee, if situation warrants exercise of that power. Further, as on the date on which the judgment was rendered, the term of the Committee had already expired and the power conferred on the Board as per Annexure A1 was never exercised. In the said circumstance, we do not find any ground to review the judgment.
The Review Petitions are, accordingly, dismissed.
