Respondent/Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House Officer, Chinna Chowk U/G Police Station, YSR Kadapa District to release the petitioners/accused on bail in the event of their arrest in connection with Crime No.87 of 2014 of Kadapa U/g Police Station, YSR Kadapa District in the interest of justice..
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri D.Purnachandra Reddy, Advocate for the Petitioners and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“Petitioners are A2 and A3. They seek for grant of anticipatory bail. They allegedly committed offences under Sections 498-A and 306 read with Section 34 IPC. A2 is a lady and A3 is a Forest Beat Officer. They are the parents in law of the deceased. The deceased committed suicide and left a suicide note, where no allegations were made against the petitioners. In view of the fact that the first petitioner is a lady and the second petitioner is a Government Servant and in view of the suicide note, I consider it appropriate to enlarge the petitioners on anticipatory bail.
Consequently, this Criminal Petition is allowed. The petitioners shall surrender before the learned II Additional Judicial Magistrate of First Class, Kadapa YSR District, within two weeks from today. On such surrender, the learned II Additional Judicial Magistrate of First Class, Kadapa YSR District, shall enlarge the petitioners on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties each in a likesum to his satisfaction.”
