HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 39922 of 2014 ORDER:
Vendors of petitioner claim to be owners and in possession and enjoyment of the house property D No.2/244, in an extent of Ac.0.07, Ward No.2 in Survey No.17, Dorasanipalli village, Proddaturu mandal, YSR Kadapa district. Vendors of petitioner claim to have purchased the same vide registered sale deed document No. 5025/1996 dated 2.11.1996. Petitioner claims that it is a private property. Petitioner contends that he wants to purchase the same when he intended to present deed of conveyance for registration, Sub Registrar refused to receive and register the document.
Learned counsel for petitioner contends that it is illegal on the part of the Sub Registrar even to refuse t o receive and process the deed of conveyance at the threshold and it is without power or jurisdiction.
However, no material is placed on record to show that such document is placed before the Sub Registrar and Sub Registrar refused the same.
Having regard to the same, liberty is granted to the petitioner to present the document before the Sub Registrar with all relevant material in support of his claim and as and when such document is presented, Sub Registrar shall receive and process the same in accordance with Registration Act, 1908, and the Indian Stamp Act, 1899. If Sub Registrar is not agreeing to register the document, he shall pass orders assigning reasons and communicate the same to the petitioner within three weeks from the date of presentation of the document.
Accordingly the writ petition is disposed of. No costs. Having regard to the same, miscellaneous petitions are closed.
