State of Karnataka by Kumbalagodu Police Station 560 098 Represented by SPP High Court Building Bangalore – 560 001 (By Shri Honnappa, HCGP) …Petitioners …Respondent This Criminal Petition is filed under Section 439 of Cr.P.C. praying to enlarge the petitioner on bail in Crime No.236 of 2019 registered by Kumbalagodu Police Station, Ramanagara for the offence punishable under Section 342 and 395 of Indian Penal Code.
These Criminal Petitions coming on for orders, this day, the Court made the following:
O R D E R Heard the learned counsel for the petitioners in both the petitions, learned HCGP for the respondent-State. Perused the records.
2. The petitioner in Criminal Petition No.7975 of 2019 is arraigned as accused No.6, wherein the petitioners in Criminal Petition No.8010 of 2019 are arraigned as accused No.4 and 5.
3. The brief facts of the case are that on 02nd November, 2019, the complainant had come back from Raichur to Bangalore and he telephoned to his friend Shivu, both of them wandered around Yeshwanthpur and Hebbal, done their shopping and thereafter decided to go to a massage centre for the purpose of having massage. Then both of them had been to a BDA apartments where they found that massage would be done in that particular building. They went to house No.702 in the seventh floor and tapped the door, then a lady opened the door, and thereafter, a person immediately pushed them inside the house. There, three more persons and a lady were there, they caught hold these two persons and out of them one person showed the knife and they actually robbed an amount of Rs.30,000/- and also told the complainant to go to ATM and bring some more money. Then the complainant went out of the said house and immediately he escaped from the clutches of the accused and went to police station and lodged a complainant. On the above said allegations, the police are investigating the matter. It is still in the FIR stage. The accused have been nabbed and permission has been sought for identification parade in order to identify the accused.
In the above said circumstances, it is too premature to grant bail, particularly, when the identification parade is still pending. Hence, both the petitions are dismissed with liberty to the petitioners to approach the Trial Court immediately after final report is submitted by the police.
