Sri H.P. Srivastava, learned Additional Chief Standing Counsel says that the writ petition was filed challenging the notice issued under Section 21(2) of the U.P. Trade Tax Act dated 7.3.08 and there is no interim order, therefore, the writ petition must have become infructuous by efflux of time.

Learned counsel for the petitioner does not dispute the aforesaid position.

The writ petition is accordingly dismissed as having become infructuous.

However, dismissal of this writ petition would not come in the way in challenging the assessment orders, which might have been passed on reassessment.
