Petitioner is permitted to implead 'District Basic Education Officer, Muzaffar Nagar' as respondent no.5 in the petition. Notice on behalf of newly impleaded respondent has been accepted by learned Standing Counsel.
Petitioner claims to have been appointed as Assistant Teacher in Sri Guru Nanak Junior High School, Khatauli, Muzaffar Nagar, which is a recognized institution upon which provisions of Uttar Pradesh Junior High Schools (Payment of Salaries of Teachers and Other Employees) Act, 1978 are applicable. Grievance is that petitioner's appointment has already been approved by the District Basic Education Officer on 09.01.2019 and he has also joined, but payment of salary is not being released to the petitioner.
Learned counsel for the respondents submits that petitioner's grievance shall be examined by the authority competent in accordance with law, expeditiously.
In the aforesaid facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.5 to accord consideration to petitioner's grievance relating to denial of salary to him. The officer concerned shall call for records and pass necessary orders, after notice to respondent no.4, and necessary instructions in that regard would also be issued to respondent no.3. Required consideration would be made within a period of three months from the date of presentation of copy of this order.
