HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.36583 of 2014 ORDER:
The petitioner purchased the agricultural land to an extent of Ac. 1.09 cents in Survey No.422/1 of Settipally Village, Tirupati Urban Mandal, Renigunta Sub-Division, Chittoor District. When the Deed of Conveyance is presented before the Sub-Registrar, Renigunta, Chittoor District (3rd respondent) after paying the requisite stamp duty and registration charges, he refused to process the document for registration. The said document was not released on the ground that the petitioner has not produced pattadar passbook and title deed. Vide letter, dated 30.05.2012, and by an endorsement, dated 17.01.2014, the Tahsildar, Tirupati Urban Mandal, Tirupathi, Chittoor District (4th respondent) informed that no pattadar passbooks or title deeds were issued to Survey No.401 of Settipalli Village, Tirupati Urban Mandal, Chittoor District. However, the Sub-Registrar refused to process the document for registration. Hence, this writ petition.

When the writ petition is taken up for consideration, learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue submitted that the issue raised in this writ petition is covered by the earlier order of this Court in W.P.No.25054 of 2012. The issue raised in this writ petition is concerning the same village in W.P.No.25054 of 2012.

For the reasons alike, this Writ Petition is disposed of directing respondents 2 and 3 to process the Deed of Conveyance presented by the petitioner without insisting for production of pattadar passbook or title deed taking into account, the letter of the Tahsildar, Tirupati Urban Mandal, Tirupathi, Chittoor District (4th respondent), dated 30.05.2012, and endorsement, dated 17.01.2014. However, it is left open to the registering authority to verify as to whether the document presented by the petitioner is in accordance with the provisions of the Registration Act, 1908, and the Indian Stamp Act, 1899. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
