Pallassena Service Co-Operative ... vs The Assistant Registrar Of ...

High Court Of Kerala|28 January, 1998

JUDGMENT / ORDER

This writ petition is filed by a Co-operative Bank challenging the order of dismissal of the arbitration case filed by them to recover money from the party respondents. Against the dismissal, the Bank filed an appeal before the Tribunal. That appeal was also dismissed. Though the petitioner was directed to take steps to serve notice on the respondents, no steps were taken.
2. Perused the impugned orders. On going through the impugned orders, I find there is no scope of exercising the power of judicial review to interfere with the orders passed in as much as that there is no infirmity with the decision making process of the authorities. The petitioner laid the arbitration case praying for recovery of money stating that on the stock verification, it was found that there was deficit in stock. The Arbitrator found that there was no admissible evidence W.P.(C) No.6011/2004 2 regarding the general work allotment indicating the responsibility for the stock and therefore, the respondents cannot be made liable for such loss. In appeal, the Tribunal also found that there was no material to show the extent of liability on the party respondents.
If that being the position, this writ petition is only to be dismissed.
Accordingly, this writ petition is dismissed.
