This petition has been filed with the following prayers:-
"i) To issue a writ, order or direction in the nature of mandamus directing the respondents not to interfere in the peaceful possession of the petitioners and not to demolish the construction of the petitioners existing over Kharsa No. 99, 100, 101 & 102 village Budha, Tehsil Dadari, District Gautam Budh Nagar.
ii) To issue any other writ order or direction which this Hon'ble court may deem fit and proper in the circumstances of the case.
iii) To award cost of the writ petition to the petitioners."
It is pointed out by Sri Kaushalendra Nath Singh, learned counsel appearing for NOIDA that he has been instructed to state that at present notice for demolition has not been issued and that it is only after a notice is issued that steps can be taken for demolition of structure raised in an illegal manner.
Such being the position, the petitioners do not have any grievance at present.
The Writ Petition is dismissed.
