Petitioner/A3 AND The State of A.P., rep. by its Public Prosecutor, High Court of A.P., Hyderabad, through its SHO, Rampachodavaram PS, East Godavari District . Respondent/Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to grant anticipatory bail to the Petitioner/A-3 in the event of his arrest in connection with FIR No.4 of 2014 of Rampachodavaram PS, East Godavari District.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri N. Siva Reddy, Advocate for the Petitioner and of the Addl. Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“The petitioner is A3. He seeks for grant of anticipatory bail. He allegedly committed offences under Section 409, 420, 468, 477-A and 120-B read with Section 109 IPC. The petitioner is a retired senior accountant in the Sub-Treasury Office at Rajahmundry. He is described to be 62 years old. He allegedly misappropriated the monies of the Government. A4 was also enlarged on anticipatory bail by me through orders in Criminal Petition No.1381 of 2014. The learned counsel for the petitioner also pointed out that A1 and A2 were also enlarged on anticipatory bail. Where the petitioner is a senior citizen and he retired as Senior Accountant in the Sub-Treasury Office, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Consequently, this Petition is allowed. The petitioner shall surrender before the learned Judicial Magistrate of First Class, Rampachodavaram, within two weeks from today. On such surrender, the learned Judicial Magistrate of First Class, Rampachodavaram, shall enlarge the petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.”
