For Petitioners : Mr.C.Prakasam For Respondent : Mr.C.Emalias, Addl. Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the respondent police not to harass the petitioners under the guise of registering a false case against them.
2. It is the case of the petitioners that on 11.02.2017, one Gopalasamy who is living with the petitioners' nearby house, has preferred a false complaint against them, based on which, the respondent police came and attempted to arrest the petitioners. Further, they insisted the petitioners to vacate the house and village, so as to enable the said Gopalasamy to enjoy the land and house belonging to the petitioners. Again on 04.03.2017, when the first petitioner aged about 75 years, was alone in the house, the respondent police came and enquired where about of other petitioners and also threatened her to register a false case against them. Hence, the present petition came to be filed.
3. Learned Additional Public Prosecutor, on instructions, submitted that there was no such threat or harassment caused by the respondent, as alleged by the petitioners. Learned Additional Public Prosecutor further submitted that a case in Crime No.99 of 2017 was registered against the petitioners and the presence of the petitioners is required for completion of enquiry.
4. The submission so made by the learned Additional Public Prosecutor is recorded. In order to give quietus to the issue, this Court directs the petitioners to appear before the respondent and on such appearance, the respondent is directed to conduct enquiry in connection with Cr.No.99 of 2017 and to act as per law.
5. Accordingly, this Criminal Original Petition is disposed of.
