Heard learned counsel for the petitioner and learned A.G.A. for the State.
The present writ petition has been filed with the prayer to quash the First Information Report dated 22.01.2021 registered as Case Crime no.41/2021 under Section 354-C, 354A(1)(iii), 354- D(1)(ii), 509, 506 IPC and Section 67 Information and Technology Act 2008, P.S. Kasna, District Greater Noida (Gautam Budh Nagar). Further prayer has been made to recover the victim as early as possible.
Learned A.G.A. submits that chargesheet has already been submitted in the matter and as such the writ petition has rendered itself as infructuous and the same is liable to be dismissed.
Confronted with this situation, learned counsel for the petitioner prays that leave may be accorded to avail the remedy as available in law.
In view of the above, the writ petition is dismissed as having become infructuous with the aforesaid liberty.
