THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.23902 of 2014 ORDER :
The case of the petitioner is that there is an agreement of sale between the petitioner with Sri Boreddy Gopal Reddy dated 25.12.2012 concerning the lands to an extent of Ac.0.57 ½ cents and Ac.0.45 cents in Survey Nos.365/1 and No.365/2A respectively at Kammarivani Chenu, Allagadda Village, Allagadda Mandal, Kurnool District. Alleging that the vendor is not honouring the commitment, the petitioner instituted O.S.No.47 of 2013 on the file of Junior Civil Judge, Allagadda for specific performance. The said suit was decreed in favour of the petitioner. In spite of the decree granted in his favour, as the vendor was not executing the sale deed, petitioner filed E.P.No.1 of 2014. The trial Court directed the petitioner to ascertain the valuation and other relevant procedure for registration of the document through Court. Accordingly, when the petitioner approached the Sub-Registrar, Allagadda, Allagadda Mandal, Kurnool District-4th respondent, the 4th respondent is not willing to furnish the particulars as sought by him. However, no material is filed to substantiate the condition that in spite of a request made by the petitioner, 4th respondent is not furnishing the information requested by him.

Having regard to the above facts, without expressing any opinion on merits, this Writ Petition is disposed of giving liberty to the petitioner to submit a representation in writing to the Sub-Registrar, Allagadda Village (4th respondent) requesting to furnish required information and as and when such representation is made, the request of the petitioner shall be considered and an appropriate decision be communicated to the petitioner within a period of two weeks from the date of receipt of a copy of such representation.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
