Heard learned counsel for the petitioners and the learned Government Advocate.
Under challenge in the instant writ petition is the FIR relating to Case Crime No.850 of 2010 under Sections 419,420, 467, 468, 471 I.P.C., Police Station Nighasan, District Kheri.
We have gone through the contents of the FIR. The disputes, which have been forwarded in the shape of argument by the learned counsel for the petitioners with prayer to quash the FIR, are disputed question of fact in respect to the parentage of the petitioner, which cannot be looked into at this juncture. Since the FIR also discloses commission of cognizable offence, as such the same cannot be quashed.
Petition is misconceived and is according dismissed.
However, it is provided that if the petitioners surrender and move application for bail, the same shall be considered and disposed of expeditiously by the courts below.
