The petitioner has undertaken a work on behalf of the Agricultural Department for modification of the pond at Duck farm, Niranam, Pathanamthitta for five lakhs. The petitioner presented the final bill. The petitioner's bill has not been sanctioned. The petitioner was told that he can only claim for the final bill in accordance with the seniority for disbursal of the final bill as applied in the Public Works Department. The petitioner submitted that the fund is made available by the Agricultural Department and therefore, he need not wait for his turn in accordance with the seniority for disbursal as in the Public Works Department.

The learned Government Pleader also submitted before this Court that a communication dated 26.9.2014, it is stated that Rs.300 lakhs is made available under the account of the Agricultural Department and on receipt of administrative sanction W.P.(C) No.21688 of 2014 2 from the Animal Husbandry Department, the allotment can be made. In this case, the administrative sanction has already been accorded. In view of the above, no separate allotment is necessary.
Accordingly, the second respondent shall release the final bill to the petitioner within two weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
