Heard Sri Ashwani Mishra, learned counsel for the petitioners and learned standing counsel for the respondent nos. 1, 2 and 3.
The petitioner in the writ petition is seeking a direction to the respondent no.3 District Inspector of Schools, Fatehpur to give financial approval for appointment of the petitioners on the post of Assistant Teacher.
A reference has been made to the direction given by this Court in Writ-A No.- 22343 of 2016 in the case of Vijay Narain Dwivedi Vs. State of U.P and three others, vide order dated 16.5.2016 that was relating to Shri Ramchandra Sanskrit Vidyalaya, Mugra Badshahpur, Jaunpur whereby the petitioner therein was appointed as Assistant Teacher (Sanskrit). In the present case, the petitioners are stated to have been appointed as Assistant Teacher in Balakgiri Madhyamik Vidhayala, Raipur, Alampur Giriya, Fatehpur but since financial approval has not been granted, they are not receiving their salary.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with a direction to the respondent no.3 District Inspector of Schools, Fatehpur to examine the matter and pass appropriate orders in accordance with law, expeditiously preferably within a period of three months from the date of receipt of a certified copy of this order in his office.
It is made clear that the court has not adjudicated the claim of the petitioners on merit.
