JUDGMENT / ORDER

1. Petitioner has approached this Court challenging Ext.P7 by which the Revenue Divisional Officer has rejected his request for correcting the entries in the Basic Tax Register (BTR) relating to the property having an extent of 04.30 Ares and 00.68 Ares comprised in Sy.Nos.463/18-2 and 463/17 of Nedumbassery village, which was recorded as 'Nilam' and cannot be changed as per the existing law.
2. A perusal of Ext.P6 report of the Village Officer indicates that the aforesaid property is recorded as 'Nilam' in the Data Bank entry as well.
3. Petitioner has a case that he has constructed a building in 1999 itself and therefore he is entitled to get correction of the entry in W.P.(C)No.11770/2014 -:2:-
the Basic Tax Register. As long as the Data Bank Register also confirms with the entry in BTR, probably the revenue authorities will not be in a position to make necessary correction on the basis of the present situation of the property.
4. Learned Government Pleader submits that until the Data Bank entries are corrected, the petitioner cannot claim any correction in the BTR. He relies on a judgment of this Court in Ratnakaran v. LBS Centre for Science and Technology (2014 (1) K.L.T.
194). It is further submitted that even if the data bank entries are corrected, the correction in BTR will also have to be considered in accordance with the procedure prescribed.
5. Having regard to the nature of the contentions, I am of the view that this writ petition can be disposed of as under:
Petitioner shall take necessary steps to correct the W.P.(C)No.11770/2014 -:3:-
data bank entries in the notification issued by the Local Level Monitoring Committee and if necessary corrections are made, the petitioner can approach the revenue authorities afresh, in accordance with law.
Writ petition is disposed of accordingly.
