Petition filed under Section 439 Cr.P.C. 2. Petitioner is the accused in Crime No.61 of 2014 of Nedumangad Excise Range Office, for the offence punishable under Section 55(i) of the Kerala Abkari Act.
3. The allegation against the petitioner is that on 21.9.2014, he was found in possession of 2.800 Litres of Indian Made Foreign Liquor, in contravention of the provisions of the Abkari Act.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor. The learned Public Prosecutor has opposed the petition, on the ground that 4 other similar antecedents are there on the part of the petitioner. It seems that the petitioner has antecedents of similar offences. Considering the same, this B.A.No.7454 OF 2014 2 Court is of the view that the petitioner is not entitled to be enlarged on bail.
In the result, this Bail Application is dismissed.
