…Respondents.
HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 15930 OF 2007.
ORDER:
Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
This Writ Petition was filed challenging action of the respondents in not sanctioning the bills under the contract works, namely, (1) Sweeping of roads from Panama godown to B.N.Reddy colony from 01.04.2006 to 31.3.2007 at night times; and (2) Sweeping of roads from Auto nagar Petrol Pump to Bennuri complex, Hayatnagar from 01.04.2006 to 31.3.2007 at night times as per agreement dated 19.09.2006.
This Court by order dated 10.12.2007 directed the respondents to consider the representation of the petitioner dated 5.6.2007 and dispose of the same. When the respondents did not take any action pursuant to the said direction, this Court again directed on 8.10.2014 to implement the order of this Court dated 10.12.2007. Pursuant to the said order, the first respondent passed an order in proceedings No.F1/2560/2007, dated 03.11.2014 stating that no amount need be paid to the petitioner as per the records and accordingly the representation of the petitioner dated 5.6.2007 was disposed of . A copy of the said proceedings was communicated to the learned Standing Counsel, who served a copy of the same to the learned Counsel for the petitioner. After perusing the same, learned Counsel for the petitioner submitted that notices under references 3 to 7 were not served on the petitioner and he seeks a copy of the same to take further action in the matter. Learned Standing Counsel for the respondents fairly submitted that the copies of notices under references 3 to 7 of proceedings of the first respondent dated 03.11.2014 would be served to the learned Counsel for the petitioner within two weeks.
Recording the said statement of the learned Standing Counsel for the respondents, the Writ Petition is disposed of giving liberty to the petitioners to take further necessary action pursuant to the order of the first respondent dated 03.11.2014.
Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
JUSTICE A. RAMALINGESWARA RAO DATED 12th November, 2014. Msnrx
