THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION No. 241 of 2014 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed for the following relief:
“…… to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the 3rd respondent in seizing the 5th respondent educational institution i.e., Rao’s Educational My Techno School vide the impugned Rc.No.Private Schools Visits/DEO/2014, dated 17.06.2014 as illegal, arbitrary, unjust, biased, against the principles of natural justice and consequently direct respondent 1 to 4 to forthwith permit the 5th respondent school to run and to pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”
It is clear from the aforesaid relief that the impugned action has been taken by the respondent officials against the 5th respondent school, which has not come forward to challenge the same. Hence, it is not a public interest litigation. The petitioner appears to be a busy body. She challenged the action of respondent Nos.1 to 4 in relation to a school in which she is not even interested at all.
We therefore dismiss the writ petition, as the petitioner has no locus to question the impugned action.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
