The report of Chief Judicial Magistrate, Ballia dated 05.12.2019 indicates that appellant Padam Deo Singh, s/o Chandradhar Singh, r/o village Kheosar in Criminal Appeal No.544 of 1998 and appellant Mahanth Singh, s/o Havaldar Singh, r/o village Kheosar in connected Criminal Appeal No.4927 of 2008 had died in the year 2004 and 2011; respectively. The verified death report is hereby accepted.
Sri Ashutosh Singh, learned Advocate holding brief of Sri L.P.Singh, learned counsel appearing for the appellant also states the said fact.
Both the appeals i.e. Criminal Appeal Nos.544 of 1998 & 4927 of 2008 are hereby abated.
The lower court record be sent back.
