Heard Sri M.Sudhir Kumar, learned counsel appearing for the petitioner and Sri Chandra Murthy, learned Special Standing Counsel appearing for the 3rd respondent.
2. The petitioner is a Field Assistant under Mahatma Gandhi National Rural Employment Guarantee Scheme. He was suspended from service by proceedings dated 01-9-2014. It is submitted by the learned counsel appearing for the petitioner that the suspension is not based on any proper complaint and also not in accordance with the procedure prescribed for initiating disciplinary proceedings against the Field Assistants under the Scheme. Therefore, the learned counsel appearing for the petitioner seeks to suspend the suspension order.
3. On the other hand, the learned Special Standing Counsel appearing for the 3rd respondent-Authority submits that there are specific allegations against the petitioner and since the order impugned is a suspension order pending enquiry, no interim order can be passed.
4. Considering the submissions made by both the learned counsel, the writ petition is disposed of with a direction to complete the enquiry within a period of one month from the date of receipt of a copy of this order and pass appropriate orders thereon as per the rules governing the enquiry under the Scheme.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
