Respondent/Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the SHO, Payakaraopeta PS., Visakhapatnam District to release the petitioner on bail in the event of his arrest in connection with Crime No. 137 of 2013 of Payakaraopeta PS., Visakhapatnam District.
The petition coming on for hearing, upon perusing the petition and the Memo of grounds filed herein, and upon hearing the arguments of SRI M. SURYA KUMAR, Advocate for the Petitioner, and of the Public Prosecutor, for the Respondent, the Court made the following ORDER The petitioner is A1. He seeks for grant of anticipatory bail. He allegedly committed offences under Section 147, 148, 324, 447 and 324 read with Section 149 IPC. The learned counsel for the petitioner submitted that the complaint against the petitioner is a counterblast to the complaint lodged by the petitioner. He further submitted that the other accused barring from A3 had already been enlarged on bail. In view of the nature of the offences alleged against the petitioner, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Hence, this Petition is allowed. The petitioner shall surrender before the Additional Judicial Magistrate of First Class, Yelamanchili, Visakhapatnam District, within two weeks from today. On such surrender, the learned Additional Judicial Magistrate of First Class, Yelamanchili, Visakhapatnam District, shall enlarge the petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.
