HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.37366 of 2013 ORDER:
The petitioner claims that she is the owner of land to an extent of Ac. 10.60 cents in Survey Nos.25/1 and 25/2 of Chippada Village, Bheemunipatnam Mandal, Visakhapatnam District. The petitioner traces the history of passing on title and claims that the title was validly passed on to her and there is no dispute regarding the status of the land. However, when the petitioner went before the Sub-Registrar, Bheemunipatnam Mandal, Visakhapatnam District (2nd respondent) for obtaining a nil encumbrance certificate in order to avail crop loan, the petitioner was informed that the land was notified in the List of Prohibited Properties by the revenue authorities and, therefore, no information as requested can be furnished. Surprised and shocked by this development, the petitioner submitted a representation to the District Collector, Visakhapatnam District (4th respondent) on 20.06.2013 through proper channel requesting to delete from the List of Prohibited Properties, as the property owned by the petitioner is private patta land. The District Revenue Officer, Visakhapatnam District (4th respondent) requested the Tahsildar, Bheemunipatnam Mandal, Visakhapatnam District (5th respondent) to send report on the status of the claim made by the petitioner.
2. Learned counsel for the petitioner submits that so far no further action is taken and no decision is communicated to the petitioner compelling her to file this writ petition.
3. Having regard to the submissions made and without expressing any opinion on merits, the Writ Petition is disposed of directing the District Collector, Visakhapatnam District (3rd respondent) to consider the representation submitted by the petitioner on 20.06.2013 and to pass appropriate orders as warranted by law and communicate the decision to the petitioner within a period of four (4) weeks from the date of receipt of copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
