ORDER:
This Writ Petition is filed for a mandamus to set-aside proceedings in Dis.No.K6/DMV/543/2012, dated 29-7-2013 of respondent No.1 whereby he has confirmed the orders of respondent Nos.2 and 3.
The petitioner’s fair price shop authorisation was suspended by proceedings in Reference.No.611/2010/F, dated 14-5-2010 of respondent No.3 pending enquiry. The said order was confirmed in appeal vide proceedings dated 20-6-2012 by respondent No.2. The Revision Petition filed by the petitioner against the said two orders was dismissed by respondent No.1 by order dated 29-7-2013.
At the hearing, the learned Counsel for the petitioner has not disputed that the entire litigation pertains to the order of suspension pending enquiry and that as a result of the suspension order passed by respondent No.3, his client is not functioning as fair price shop dealer for the last four years.
Inasmuch as the enquiry is pending, it is appropriate that respondent No.3 completes the same and passes a final order within a reasonable time. Accordingly, respondent No.3 is directed to complete the enquiry wherein he shall give an opportunity of being heard to the petitioner, pass a detailed speaking order and communicate the same to the petitioner within a period of two months from the date of receipt of this order.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel to the disposal of the Writ Petition, WPMP No.33017 of 2013 is disposed of as infructuous.
