JUDGMENT / ORDER

THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR
Writ Petition No.4395 of 2009
DATED:17.11.2014 Between:
P.V. Krishnama Chary, Bhadrachalam, Khammam District.
And The Government of Andhra Pradesh, Represented by its Principal Secretary, Home Courts, Hyderabad and another.
… Petitioner ….Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR
Writ Petition No.4395 of 2009
Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta)
This writ petition has been filed asking the following reliefs:
“To issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 1st respondent in not taking steps to appoint Judicial Officer on deputation basis to run Civil Court, i.e., Bhadrachalam Mobile Court as per the directions of the Hon’ble High Court pursuant to the Bar Association representation dated 30.5.2007 is illegal and void and opposed to Articles 14,19 and 21 of the Constitution of India and consequently to direct the 1st respondent to establish the Civil Court in all agency areas by appointing Judicial Officers in accordance with law and pass such other order or orders.”
Looking at the prayer, we are of the view that this is a policy decision to be taken by the High Court under the particular norms and procedure. The petitioner cannot question that. Only, it has to be done in regular process. However, it would be open for the petitioner to approach the learned District Judge in whose jurisdiction the Court is sought to be established. If the petitioner approaches the learned District Judge, the learned District Judge may examine this matter in accordance with law and whether the suggestion is viable or not.
The writ petition is accordingly disposed of.
Consequently, the Miscellaneous petitions, if any, pending shall also stand closed. No costs.
